Business Terms of Service

These Business Terms of Service ("Business Terms") supplement the general Terms of Service and govern your use of Sober Friend as a sober living home operator. By creating a business account, you agree to these terms.

1. Operator Responsibilities

1.1 Accurate Information

You agree to provide and maintain accurate, current, and complete information about your business, including:

  • Business name, location, and contact information
  • Services offered, house rules, and pricing
  • Bed availability and capacity
  • Insurance acceptance policies
  • Photos and descriptions that accurately represent your property

1.2 Legal Compliance

You must:

  • Maintain all licenses, permits, and certifications required by your jurisdiction
  • Comply with applicable housing, zoning, and safety regulations
  • Follow applicable state and local sober living guidelines (e.g., NARR standards if applicable)
  • Adhere to fair housing laws and anti-discrimination requirements

2. Resident Data and Privacy

2.1 Data Handling

When you enter resident information into the platform, you represent that you have the appropriate consent or authority to do so. You are responsible for:

  • Obtaining necessary consent from residents before entering their personal information
  • Using resident data only for legitimate operational purposes
  • Not exporting or sharing resident data inappropriately
  • Managing staff access so that only authorized personnel can view resident information

2.2 Data Security

We encrypt personally identifiable resident data at rest using AES-256-GCM and enforce tenant isolation through row-level security policies. While we implement strong safeguards, you remain responsible for securing access to your account and training your staff on data handling practices.

2.3 Not a HIPAA Covered Entity

Most sober living homes are not HIPAA-covered entities. Sober Friend is not designed or marketed as a HIPAA-compliant platform. If your organization is a covered entity under HIPAA, you should evaluate whether the platform meets your compliance requirements before entering protected health information. Contact us if you need to discuss a Business Associate Agreement.

3. Staff Management

When you invite staff members (house managers or case managers) to the platform:

  • You are responsible for granting appropriate access levels
  • Staff access should be revoked promptly when a staff member leaves your organization
  • Staff members you assign to multiple houses will have access to resident data at each assigned house
  • You are responsible for the actions of staff members you authorize on the platform

4. Rent Collection (Stripe Connect)

If you enable rent collection:

  • You must complete Stripe Connect onboarding, including identity verification and bank account setup
  • You agree to Stripe's Connected Account Agreement and Stripe's terms of service
  • Sober Friend currently charges no platform fees on rent payments — standard Stripe processing fees still apply
  • Payouts are sent directly to your connected bank account on Stripe's standard schedule (typically 2 business days)
  • You are responsible for the accuracy of rent amounts and due dates entered into the platform
  • Automated rent reminders will be sent to payers (or to you if no payer is designated) based on due dates you set
  • You are responsible for handling refunds, disputes, and payment plans with your residents and payers

5. Subscriptions and Plans

  • Business accounts are available on Free, Basic ($99/mo), Progress ($129/mo), and Structured ($149/mo) tiers
  • Feature access (client management, compliance tracking, staff management, medication tracking, competitor reports) varies by plan
  • Paid plans are billed monthly via Stripe and can be managed through the billing portal
  • Downgrading your plan restricts access to higher-tier features but does not delete your data
  • If your subscription lapses, your listing remains visible but dashboard access may be limited until payment is resolved

6. AI Mentor and Escalation Alerts

If your plan includes the AI recovery mentor for residents:

  • The AI mentor provides conversational support only — it is not a substitute for licensed clinical staff
  • When risk-related language is detected, you will receive an escalation alert with the risk category, severity, and timestamp
  • Conversation content is not shared in escalation alerts to protect resident privacy
  • Acting on escalation alerts is your responsibility — the platform provides the alert, not the intervention
  • You should not rely on the AI mentor as your sole risk detection mechanism

7. Directory Listing

  • Your business listing is visible in the public sober living directory
  • Listing content (photos, descriptions, amenities) must accurately represent your property
  • We may remove or flag listings that contain inaccurate, misleading, or inappropriate content
  • Listing rank and visibility may be affected by plan tier, completeness of information, and engagement metrics

8. Non-Discrimination

You agree to:

  • Not discriminate based on race, color, religion, gender, sexual orientation, national origin, age, disability, or any other protected status, except as permitted by applicable fair housing exemptions for single-sex sober living facilities
  • Provide equal access to services within the populations you serve
  • Handle all inquiries and admissions fairly and professionally

9. Data Portability and Termination

  • You may request a data export of your business and resident records at any time
  • Upon cancellation, your data is retained for a reasonable period to allow for re-activation or export, after which it is permanently deleted
  • We may suspend or terminate your account for material violations of these terms, with notice

10. Liability

  • You are solely responsible for the quality of housing, care, and services you provide to residents
  • Sober Friend is a technology platform — we do not inspect, certify, or endorse any sober living home
  • You agree to indemnify Sober Friend against claims arising from your operation of your sober living home, your use of the platform, or actions taken by your staff
  • You are responsible for maintaining appropriate liability insurance for your operations
